General Release and Waiver of All Claims

Your participation in this program is voluntary. Users hereby release and discharge Feeding Hawaii Together, and each of their former, current and future directors, officers, shareholders, predecessors, successors, assigns, affiliates, board members, agents, insurance carriers, attorneys, servants, employees from each and every claim, cause of action, damages (including consequential damages) and demands, loss and expense, including but not limited to attorneys fees and costs, that it has or might have, in any way arising out of or in connection with this Agreement or the Goods (including any liability for any possible spoilage or food-borne illness) except to the extent that any such liability cannot be released or waived under applicable Federal, state or local law. The foregoing shall, to the fullest extent of applicable law, be in addition to, and not in replacement or substitution of, any legal protections offered by any “Good Samaritan” or other similar laws in any jurisdiction. MISCELLANEOUS. *Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase the risk of food borne illness. **This location offers products with peanuts, tree nuts, soy, milk, eggs, and wheat. While we take steps to minimize the risk of cross-contamination, we cannot guarantee that any of these products are safe to consume for people with food allergies.

Terms & Conditions of Use

The following terms and conditions, together with any documents they expressly incorporate by reference, including without limitation the Privacy Policy (collectively, these “Terms of Use”), govern your access to and use of www.thepantry.org including any content, functionality and services offered on or through www.thepantry.org (the “Site”).

This Site is offered and available to users who are 13 years of age or older. By using this Site, you represent and warrant that you meet the foregoing eligibility requirement. If you do not meet this requirement, you must not access or use the Site.

The information presented on or through the Site is made available solely for general information purposes. We may update the content on this Site from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.

We reserve the right to refuse service.

Collection of Information

In the course of using the Site owned and operated by The Pantry by Feeding Hawaii Together may ask you for certain information, including, but not limited to, your name, email address, postal address, telephone number and fax number. Such information is provided voluntarily and knowingly. In general, you can visit our Site without telling us who you are or revealing any personal information about yourself; however, you must provide personal information in order to make a donation.

We may also ask for certain information about you when you make a donation on the Site. This information may include your name, mailing and billing address, zip code, phone number, billing information and/or email address. This information may be required to complete your donation.

The Pantry may also collect non-personally identifiable information when you visit our Site, including but not limited to such information as the type of browser you are using (e.g., Safari, Chrome, Internet Explorer), the type of operating system you are using, (e.g., Windows or Mac OS), the domain name of your Internet service provider (e.g., Verizon, AT&T), your IP address, aggregate data about the number of visits to the Site, and/or aggregate data about the pages visited, but in doing so we do not connect this information with your personal information such as your name or email address.

Our Site is not directed to children under the age of 13 years. We will not request personally identifiable information from anyone whom we know to be under the age of 13. By using our Site, you represent and warrant that you are at least 13 years old. If we become aware that a customer is under the age of 13 and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information.

The Pantry may use, retain, sell, publicize, reproduce, compile, analyze, and/or transfer aggregate and/or anonymized data for the purpose of scientific, research, educational, or commercial purposes. You grant the Pantry a perpetual, royalty free, worldwide license with right to sublicense the information in the previous sentence for such purposes described.

Notwithstanding the previous paragraph to the contrary, if you use the services provided by the Pantry or enter the Pantry’s premises, you grant the Pantry the right, in perpetuity, to use your name, image, voice, likeness, and biographical information (including without limitation all trademark rights thereof) in connection with advertising, marketing, and publicity for the services performed by the Pantry or as otherwise in connection with the Pantry’s business and operations, including but not limited to using your image on print and internet advertisements, this website, promotional materials, videos, and other forms of media.

Security Disclaimer

The Pantry by Feeding Hawaii Together has implemented security measures to help protect against the risk of loss, misuse and alteration of General Information or Personal Information under The Pantry’s control. The Pantry protects your online donation information by using Secure Sockets Layer (“SSL”) technology, which works by encrypting the information provided by consumers making a donation. Nevertheless, such security measures may not prevent all loss, misuse or alteration of information on the Site, and Food Bank is not responsible for any damages or liabilities relating to any such security failures. By using this Site, you understand that there is a risk that data and communications, including email and other electronic communications, may be accessed by unauthorized third parties when communicated over the Internet. The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

Indemnification & Limitation of Liability

You shall indemnify, defend and hold harmless The Pantry by Feeding Hawaii Together and its sponsors, business affiliates, subsidiaries, affiliates, officers, directors, employees, attorneys and agents, from and against any and all damages, claims and actions brought by you or any third party resulting from your use of the Site in violation of these Terms or the infringement by you of any Intellectual Property rights of any person or entity.

IN NO EVENT WILL FOOD BANK BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH INFORMATION OR FOR ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
